These Terms of Use ("Terms") govern your access to and use of ISLAND HOST's cloud hosting services ("Services"). By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By registering for, accessing, or using ISLAND HOST's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and ISLAND HOST.

2. Description of Services

ISLAND HOST provides boutique cloud hosting services, including but not limited to:

  • Web hosting and server infrastructure
  • Domain management and DNS services
  • Database hosting and management
  • Email services
  • Backup and disaster recovery services
  • Technical support and maintenance

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.

3. Account Registration and Security

To use our Services, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. ISLAND HOST is not liable for any loss or damage arising from your failure to protect your account information.

4. Acceptable Use Policy

You agree not to use our Services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Transmit, store, or distribute any malicious code, viruses, or harmful software
  • Engage in any form of spam, phishing, or fraudulent activity
  • Infringe upon intellectual property rights of others
  • Host or distribute illegal content, including but not limited to pirated software, copyrighted material without authorization, or content that promotes illegal activities
  • Engage in activities that could harm, disable, or impair our Services or servers
  • Attempt to gain unauthorized access to any systems or networks
  • Use our Services for cryptocurrency mining or other resource-intensive activities without prior authorization
  • Violate any applicable data protection or privacy laws

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

5. Payment Terms

Our Services are provided on a subscription basis with the following payment terms:

  • Fees are billed in advance on a monthly or annual basis, as selected
  • All fees are non-refundable except as required by law or as explicitly stated in our refund policy
  • You are responsible for providing accurate billing information and keeping payment methods current
  • Failure to pay fees when due may result in service suspension or termination
  • We reserve the right to change our pricing with 30 days' notice to existing customers
  • All fees are exclusive of applicable taxes, which you are responsible for paying

6. Service Level Agreement (SLA)

ISLAND HOST strives to provide reliable hosting services with the following commitments:

  • We target 99.9% uptime for our hosting infrastructure
  • Scheduled maintenance will be announced in advance when possible
  • We are not liable for downtime caused by factors beyond our reasonable control, including but not limited to natural disasters, cyberattacks, or third-party service failures
  • Service credits may be available for extended outages, subject to our SLA policy

7. Data Backup and Loss

While ISLAND HOST performs regular backups of hosted data, you are responsible for:

  • Maintaining your own backups of critical data
  • Ensuring the integrity and security of your data
  • Notifying us of any data loss or corruption issues

ISLAND HOST is not liable for any data loss, corruption, or unavailability, regardless of cause. We recommend maintaining independent backups of all important data.

8. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by ISLAND HOST or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload or create using our Services. By using our Services, you grant ISLAND HOST a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing the Services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISLAND HOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability for any claims arising from or related to our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless ISLAND HOST, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload or transmit through our Services

11. Termination

Either party may terminate this agreement at any time:

  • You may cancel your account at any time through your account dashboard or by contacting support
  • ISLAND HOST may suspend or terminate your account immediately for violation of these Terms or for any other reason we deem necessary
  • Upon termination, your right to use the Services will cease immediately
  • We may delete your data and content after a reasonable retention period following termination

12. Modifications to Terms

ISLAND HOST reserves the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending an email notification to the address associated with your account
  • Updating the "Last Updated" date at the top of this page

Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ISLAND HOST operates, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or our Services shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
